Pulupandan Mayor Atty. Magdaleno Peña filed a complaint for violation of Republic Act 9262 or the Anti-Violence against Women and their Children Act against his former partner Marie Roxanne "Plinky" Recto and lawyer Evalyn Ursua.
In Peña's complaint which was filed before the Negros Occidental Provincial Prosecutor's Office, he stated that he is acting on behalf of his 3-year-old son whose photograph was publicly exposed by Recto upon the advice of her lawyer Ursua.
He said the photo revealed the identity of his son despite a kidnapping plot reportedly by the New People's Army (NPA) against the child.
The complaint further stated that Recto and her lawyer brushed aside intelligence reports by the Philippine National Police and the Intelligence Service of the Armed Forces of the Philippines. The intelligence reports said that his son would be used as a pawn in exchange for the withdrawal of the murder case the mayor filed against high-ranking leaders of the Communist Party of the Philippines-NPA.
The murder case stemmed from an ambush allegedly launched by the rebels against the local chief executive May 30 last year.
